Al Ain court dismisses AED16,000 lawsuit over alleged job promise due to lack of evidence

Published:

The Al Ain Court for Civil, Commercial and Administrative Cases has dismissed a lawsuit filed by a young man seeking the return of AED16,000, which he claimed to have paid to another individual in exchange for securing a job. The court ruled that the plaintiff failed to provide sufficient evidence to substantiate his claims, emphasizing that the mere transfer of funds does not establish liability.

The plaintiff alleged that he was misled by the defendant, who promised to arrange employment with either a government or private entity. After transferring several amounts totaling AED16,000, the plaintiff claimed the defendant did not fulfill the agreement and refused to return the money. In addition to the repayment, he sought AED10,000 in compensation for material, moral, and psychological harm caused by the defendant’s actions.

During the court proceedings, the plaintiff presented evidence, including bank transfer receipts and records of telephone correspondence. However, the defendant did not appear in court to contest the claims. The court noted that while the plaintiff provided documentation of the transfers, he did not demonstrate that these transfers constituted a debt owed by the defendant.

The court clarified that a bank transfer merely signifies the movement of money from one party to another. It stated that the burden of proof lies with the plaintiff to establish that the transfers were made under a binding agreement that the defendant failed to honor. Ultimately, the court found no evidence supporting the plaintiff’s claims beyond his assertions, leading to the dismissal of the case as unfounded in both fact and law. The court also ordered the plaintiff to bear the costs of the proceedings.

This ruling underscores the importance of having clear and documented agreements in financial transactions, particularly when employment promises are involved. The court’s decision serves as a reminder that claims of this nature require substantial evidence to be upheld in a legal setting.
