Strengthening Trust in Dubai’s Real Estate: New Ruling on Service Fees

Dubai’s property market is known for its dynamic nature and progressive regulatory environment. Recently, the Dubai Rental Disputes Center (RDC) introduced a significant legal principle concerning real estate service fees, aiming to enhance trust among investors and safeguard the rights of landlords and developers.

New Legal Principle for Service Fees

The newly established guideline addresses long-standing disputes between property owners and developers regarding the obligation to pay service charges associated with jointly owned properties. This ruling aims to clarify responsibilities and enhance transparency, ensuring that all parties understand their financial obligations effectively.

Under this new framework, unit holders are required to pay service charges even if they haven’t formally taken possession of their property. This applies particularly when delays in property handover are due to issues attributed to the buyer. Designed in accordance with Law No. (6) of 2019 on Jointly Owned Properties, this legal adjustment ensures that essential costs related to management, operation, and maintenance are covered, thereby defending the interests of all stakeholders involved.

Clarifying Ownership and Service Fee Responsibilities

While the legislation addressing service fees has generally provided clear guidance, peculiar situations created some legal ambiguities. For instance, units sold through installments that have been completed but not officially registered in the buyer’s name caused confusion over who held the responsibility to cover service fees—the developer or the buyer.

To clarify this uncertainty, the matter was escalated to the General Authority for Unifying Principles within the RDC. After thorough analysis and consideration of applicable laws, the Authority found that buyers whose names appear in the pre-registration of a residential unit are responsible for service charges from the completion date of the project or from the point of any payment defaults, even if they have not yet received legal ownership.

This ruling is designed to prevent disruption in facilities operations and to protect developers and compliant unit holders from undue financial strain.

Insights from the RDC President

His Excellency Judge Abdulqader Mousa Mohammed, the President of the RDC, noted the importance of addressing this legislative gap. He emphasized that providing accountability for service charges for defaulting buyers aligns with the core principles of the law. By interpreting the law in this manner, the RDC sets a judicial precedent to eliminate confusion, thereby reinforcing the market’s stability and the provision of essential services.

This decisive action not only reassures investors but also reaffirms the integrity of Dubai’s regulatory framework in the property sector. The clear expectation for buyers to meet their financial responsibilities contributes significantly to maintaining communal living standards, benefiting all property stakeholders.

Enhancing Operational Efficiency in Property Management

The Rental Disputes Center’s initiative also highlights its commitment to operational efficiency within the real estate sector. In 2024, the RDC effectively managed and closed an astounding 49,817 execution files pertaining to jointly owned properties. This achievement underscores the Center’s proactive approach in dealing with property disputes.

In addition to legal adjudication, the RDC has introduced a self-execution service for service fee claims. This new mechanism allows property management companies to address claims swiftly, ensuring that service provision remains uninterrupted and efficient. With this streamlined process, the overarching goal is to bolster the efficiency of building management across Dubai.
