US Supreme Court Safeguards Fed Independence, Blocks Trump’s Attempt to Fire Governor Lisa Cook

WASHINGTON: The U.S. Supreme Court ruled on Monday in a 5-4 decision to prevent former President Donald Trump from firing Federal Reserve Governor Lisa Cook, reinforcing the independence of the central bank amid unprecedented challenges to its authority. This ruling marks a significant moment in the ongoing debate over presidential power and the autonomy of federal institutions.

The court’s decision not only protects Cook but also highlights a broader commitment to maintaining the Federal Reserve’s independence. In a separate ruling on the same day, the court expanded presidential authority to dismiss leaders of other federal agencies, overturning a precedent established in 1935.

Unproven Allegations

Chief Justice John Roberts, who authored the majority opinion, stated that Trump had “failed to afford Cook the procedural protections to which she was entitled by statute.” He emphasized that without these protections, Cook could not adequately contest the allegations made against her. Trump had previously cited unproven mortgage fraud claims in his attempt to remove Cook, who is the first Black woman to serve as a Federal Reserve governor. Cook has denied these allegations, asserting they were a pretext for her dismissal due to differences in monetary policy.

The ruling saw Roberts and Justice Brett Kavanaugh joining the court’s three liberal justices, while Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, and Amy Coney Barrett dissented. This decision ensures that Federal Reserve officials cannot be dismissed at will by the president, a principle rooted in the historical independence of the Federal Reserve System and its predecessors.

‘I Refused to Bow’

In response to the ruling, Cook expressed her relief, stating it affirms the Fed’s obligation to make policy decisions free from political interference. She remarked, “This was never about mortgage documents signed years before I became a Federal Reserve governor. It was an attempt to remove me on a manufactured pretext because I refused to bow to political pressure and continued to set interest rates based only on what would best serve the American people.”

The court clarified that its ruling does not resolve the factual disputes surrounding the case, which will now return to lower courts for further examination. Roberts noted that it remains an open question whether Cook committed any wrongdoing, underscoring the necessity for her to respond to the allegations.

‘Appropriate Action’

Following the decision, Trump took to social media to express his dissatisfaction. He stated, “The Cook Lawsuit, having to do with her suitability in sitting on the Board of the Federal Reserve, was sent back by the Supreme Court on a strictly procedural basis. We will take appropriate action immediately to make sure that someone who has committed wrongdoing will not be making vital decisions concerning the Welfare of the United States of America!”

Trump’s efforts to remove Cook, along with a separate investigation into former Fed Chair Jerome Powell, represent a significant challenge to the independence of the Federal Reserve since its establishment. In a related ruling, the Supreme Court upheld Trump’s authority to fire Democratic Federal Trade Commission member Rebecca Slaughter, which he described as a pivotal decision regarding presidential powers.

The Power of the Fed

The Federal Reserve plays a crucial role as the world’s most important central bank, influencing credit costs in the United States and beyond. Cook, appointed by President Joe Biden in 2022, serves a term that extends until 2038. Her role is vital in shaping U.S. monetary policy alongside the central bank’s seven-member board and the heads of its 12 regional banks.

The Supreme Court’s decision comes at a time when Trump has been vocal about his desire for the Fed to adopt more aggressive interest rate cuts to combat persistent inflation. His administration’s actions against Cook and Powell have raised concerns about the potential politicization of monetary policy.

The Federal Reserve Act

The Federal Reserve Act, enacted in 1913, was designed to insulate the central bank from political pressures, allowing governors to be removed only “for cause.” While the recent ruling did not explicitly define what constitutes “cause,” Roberts indicated that the historical context of the Federal Reserve suggests a substantial threshold must be met for dismissal.

He warned that without such constraints, any perceived misstep could serve as a pretext for removal, undermining the independence that Congress intended to preserve. Trump’s attempt to fire Cook was publicly announced on August 25, 2025, citing allegations from Federal Housing Finance Agency Director Bill Pulte, who has also suggested that Cook may face criminal charges.

Pushing the Limits

Trump’s administration has consistently tested the boundaries of presidential authority since his return to office in January 2025. His pressure on the Federal Reserve to alter interest rates has been met with resistance, with Powell and Cook maintaining their commitment to independent monetary policy.

The Supreme Court’s rulings reflect ongoing tensions between the executive branch and independent agencies, as Trump has sought to reshape various policies through executive action. While many of his initiatives have been allowed to proceed, the court’s recent decisions indicate a complex legal landscape for presidential powers.
