Ajman Rental Dispute Centre Fees Rise Following Ammar bin Humaid’s Decree
H.H. Sheikh Ammar bin Humaid Al Nuaimi, Crown Prince of Ajman and Chairman of the Ajman Executive Council, has enacted Emiri Decree No. (2) of 2026, introducing new fee structures for cases and applications submitted to the Ajman Rental Dispute Resolution Centre. The decree aims to streamline the dispute resolution process within the Emirate of Ajman.
Key Features of the Decree
The newly established fees are designed to cover the costs associated with registering and recording cases at the Centre. Notably, the decree introduces a security deposit of AED1,000 for appellants contesting decisions from the Primary Rental Committee. This deposit applies if the appeal involves breaches of jurisdictional regulations, invalidity of judgments, or procedural issues impacting the ruling.
The Case Management Office will require proof of payment for this deposit before accepting appeal petitions. If an appeal is ruled inadmissible, the deposit will be forfeited.
For petitions seeking reconsideration, a deposit of AED2,000 is mandated. This amount will be refunded if the petition is accepted, but it will be forfeited in cases where the petition is deemed inadmissible or rejected.
Mechanism for Fine Collection
The decree clarifies the procedure for collecting fines related to rental violations. The Rental Dispute Resolution Centre is now designated as the sole authority for collecting such fines, preventing the Municipality and Planning Department from imposing additional fines for the same infractions.
Abolishment of Previous Legislation
In a significant development, the decree revokes prior legislation concerning judicial fees for rental disputes in the Ajman region. Nevertheless, it permits certain provisions to remain in effect until they are supplanted by new regulations, bylaws, and decisions.
Implementation Timeline
The decree is effective immediately, having been enacted at the beginning of the current month. It will also be published in the Official Gazette, ensuring that stakeholders are informed of the new regulations.
The introduction of these fee structures marks a shift in the administration of rental disputes in Ajman, reflecting a broader effort to enhance the efficiency of dispute resolution mechanisms.
