Streamline Your Move: Essential Steps to Cancel Ejari in Dubai, Including Required Documents and Fees

Dubai tenants preparing to move out must navigate the cancellation of their Ejari registration, a crucial step in ending a tenancy contract. This process, overseen by the Dubai Land Department (DLD), ensures that tenancy agreements are officially recognized and that properties are cleared for new tenants. Understanding how to cancel Ejari online, the necessary documents, and the implications of early lease termination is vital for a smooth transition.

Understanding Ejari

Ejari is the official online registration system for tenancy agreements in Dubai, mandated by the government. Without Ejari, tenancy contracts lack recognition by government authorities, making it essential for both landlords and tenants to register their agreements. This system not only legitimizes rental contracts but also serves as a safeguard against potential disputes.

The Importance of Cancelling Ejari

Ejari registrations typically last for one year and can be renewed. However, when a tenant vacates a property or a lease is terminated, it is imperative to initiate the Ejari cancellation process. This official procedure removes the tenancy contract from the DLD register, ensuring that the record is legally closed and that the property is no longer associated with the previous tenant.

Navandeep Matta, a senior associate at Kochhar & Co. Inc. Legal Consultants in Dubai, emphasized that the Ejari record does not automatically expire when the lease term ends. It remains active until cancelled, which can prevent landlords from registering new tenants and may block outgoing tenants from securing new Ejari registrations.

Consequences of Not Cancelling Ejari

Failing to cancel Ejari can lead to several complications:

  1. Utility Account Linkage: The closure of utility accounts with the Dubai Electricity and Water Authority (DEWA) and the return of deposits are contingent upon the tenancy record.

  2. Inaccurate Address Records: A live Ejari record is linked to various official documents, including residency sponsorship and school admissions. Leaving a property without cancelling Ejari can result in inaccuracies in these records.

  3. Risk of Tacit Renewal: According to Article 6 of the tenancy law, if a tenant remains in the property after the lease term without the landlord’s objection, the contract may be deemed renewed for a similar duration. This could lead to claims for additional rent if the tenant has not formally vacated or documented non-renewal.

Early Termination of Tenancy Contracts

While early termination of a tenancy contract is permissible under Dubai law, it is not an automatic right. Article 7 of Law No. (26) of 2007 states that neither party can unilaterally terminate or amend the contract without mutual consent. The specifics of early termination are typically outlined in the ‘Additional Terms’ section of the DLD Unified Tenancy Contract.

In cases of early termination, tenants may incur a penalty equivalent to two months’ rent and must provide 60 days’ written notice. If the contract does not address early termination, tenants remain liable for rent for the unexpired lease term.

Essential Tips for Renters

Tenants considering the termination of their contracts should adhere to the following guidelines:

  • Negotiate Early: When signing the lease, request an early termination clause that includes a defined notice period and limits on compensation.

  • Serve Notice Properly: Follow the notification method specified in the contract. For significant tenancies, consider using a notary public or registered mail for documentation.

  • Obtain a Signed Settlement: Ensure that any agreement regarding termination includes details about the termination date, compensation, and the return of all cheques.

  • Document the Handover: Conduct a joint inspection during the handover, taking photographs and recording meter readings to avoid disputes over damages.

  • Cancel Ejari and Retain Documentation: Keep the cancellation certificate for future registrations and utility refunds. If cooperation from the landlord is lacking, consider filing a demand at the Rental Disputes Settlement Centre.

  • Avoid Vacating Without Notice: Leaving without proper notice or settlement can lead to claims for additional rent.

Required Documents for Ejari Cancellation

Before initiating the Ejari cancellation process, tenants should gather the following documents:

  • Emirates ID of the applicant
  • Power of Attorney details (if applicable)
  • Ejari certificate or original DLD Unified Tenancy Contract
  • No Objection Certificate (NOC) from the landlord
  • Final DEWA bill
