Costco Sues Trump Administration Over Tariffs

Costco Wholesale, widely recognized as a leading wholesale shopping destination in the United States, has initiated legal action against the Trump administration. The company has filed a lawsuit in the Court of International Trade, challenging the collection of tariffs imposed under the International Emergency Economic Powers Act (IEEPA).

Legal Challenge to Tariffs

Costco’s lawsuit underscores a proactive approach; the retailer is not waiting for the Supreme Court to potentially invalidate President Donald Trump’s extensive import taxes. Instead, the company is directly demanding refunds for the tariffs it has already paid, seeking a “full refund” based on the executive order that instituted what Trump described as “reciprocal” tariffs.

Seeking Justice in Court

As of the end of October, the government has collected a staggering $205 billion in tariffs. White House spokesperson Kush Desai issued a statement highlighting the ramifications of not upholding these tariffs, calling the economic impact “enormous.” The administration anticipates a swift and proper resolution from the Supreme Court regarding the matter.

With this recent filing, Costco joins a growing list of prominent companies seeking tariff refunds through judicial means. Other businesses like Revlon, EssilorLuxottica, Kawasaki, and Yokohama Tire have also launched similar legal actions, reflecting a broader dissatisfaction with the tariff landscape.

Historical Context of Tariffs

Trump’s administration was notable for being the first to utilize the IEEPA to impose import duties. While lower courts have ruled against the legality of using this law for imposing tariffs, they opted to maintain the tariffs during the ongoing legal proceedings.

In Costco’s legal document, attorneys argue that “the Challenged Tariff Orders cannot stand” due to a lack of clear presidential authority under the IEEPA to impose tariffs. This dispute highlights ongoing tensions between executive power and congressional authority regarding trade regulations.

Financial Impact on Costco

According to data from U.S. Customs and Border Protection, importers have paid nearly $90 billion in tariffs under the IEEPA since late September 2025. While Costco did not disclose the specific cost of tariffs to the company in its court filings, the CFO, Gary Millerchip, previously revealed that approximately one-third of Costco’s U.S. sales consist of imported products. Among these, items sourced from China account for about 8% of total sales.

Despite the financial pressures from tariffs, Costco has made a concerted effort to maintain stable prices on essential fresh food items, including pineapples and bananas. CFO Millerchip stated, “We essentially held the price on those to make sure that we’re protecting the member,” emphasizing the company’s commitment to its customer base amidst economic challenges.

Ongoing Legal Battles

The specialized U.S. Court of International Trade, along with the U.S. Court of Appeals for the Federal Circuit, recently ruled that Trump’s major tariff initiatives are illegal, with appeals now pending at the Supreme Court.

President Trump asserts that he possesses nearly unlimited authority to impose tariffs, arguing that such powers are constitutionally granted to Congress under the IEEPA. However, following two courtroom defeats, the administration’s stance faces increasing scrutiny.

As this legal battle unfolds, Costco’s lawsuit stands as a critical junction in the ongoing debate regarding the efficacy and legality of tariffs and their broader implications for American businesses and consumers.
