Understanding Civil Marriage in Abu Dhabi

A civil marriage is defined as the legal union of a man and woman, formalized as a civil contract under secular regulations. While primarily designed for non-Muslim couples, Muslim expatriates can also utilize this service for a more streamlined approach. Unlike religious marriages, civil marriages in the UAE do not necessitate witnesses or a religious ceremony, with the entire process overseen by the emirate’s Civil Court.

Eligibility and Requirements

In 2021, Abu Dhabi enacted comprehensive civil marriage legislation, marking a significant development in the region. The Abu Dhabi Law No. 14/2021 on Civil Marriage and its Effects, along with Regulation 8/2022, establishes the legal framework for civil marriage, divorce, child custody, inheritance, and arbitration in disputes.

To qualify for a civil marriage, the following criteria must be met:

  • Both parties must consent to the marriage.
  • Each party must be at least 18 years old.
  • The parties must not be related by the first or second degree.
  • Neither party may be married to another individual.
  • At least one party must not be a UAE national.

Unique Aspects of the Abu Dhabi Civil Family Court

The Abu Dhabi Civil Family Court distinguishes itself from other courts in the UAE by permitting marriages regardless of religion or nationality. The Abu Dhabi Justice Department (ADJD) confirms that Muslims can also access the civil marriage service, provided they are not UAE citizens. Additionally, non-residents and tourists can avail themselves of this service, making it accessible to a broader audience.

Application Process and Costs

The application process is designed to be straightforward, provided all necessary documentation is in order.

Step 1 – Document Preparation

Couples must gather the following documents:

  • Valid passports (both original and copies)
  • Completed marriage application form, available on the Abu Dhabi Justice Department’s website
  • Emirates IDs for UAE residents
  • Divorce certificate, if applicable
  • Death certificate, if widowed
  • Prenuptial agreement (optional)

Applications can be submitted online via the ADJD website or at one of the ADJD typing centers throughout the city.

Step 2 – Fee Payment

Couples have two options for processing their applications:

  • Regular Service: Priced at Dh300, applications are typically processed within 10 working days, after which a date and time for the marriage ceremony will be allocated based on availability.
  • Express Service: For Dh2,500, this fast-tracked option processes applications within one working day, allowing couples to select their preferred date and time for the ceremony, subject to court hours.

Should a prenuptial agreement be submitted, an additional fee of Dh940 for notarization applies.

Step 3 – Ceremony Execution

Once the marriage date and time are confirmed via email, couples must attend the Abu Dhabi Civil Marriage Section on the scheduled day. Their identification documents will be verified before proceeding to the ceremony room.

During the ceremony, a marriage notary will be present, and vows will be delivered through a pre-recorded voiceover available in seven languages. Couples requiring a language other than English should notify the court in advance to facilitate arrangements. The court aims to complete the ceremony within 15 minutes, after which both parties will sign the marriage certificate. The ADJD recommends having the certificate attested by the UAE’s Ministry of Foreign Affairs (MOFA).

Scheduling the Marriage Ceremony

Marriage ceremonies can be booked during the court’s operating hours:

  • Monday to Thursday: 9 AM to 1:30 PM
  • Friday: 9 AM to 11 AM

Guest Attendance and Photography

According to the ADJD, couples may bring as many guests as they wish to the ceremony. Witnesses are not required, as the notary public officer serves this role. Couples can also bring photographers and videographers, and they have the option to exchange rings and recite their own vows.

Rescheduling the Wedding

If a couple cannot attend the ceremony, the court requires at least 24 hours’ notice for rescheduling. While the court will attempt to accommodate requests, refunds are limited. Failure to provide adequate notice necessitates a new application and restarting the process.
